The Zinn Law Firm has obtained a $3.25 million settlement and a $2.5 million settlement for clients suffering traumatic brain injury and other bodily injuries discussed further. Below are additional settlements we have obtained on behalf of our clients who have suffered from traumatic brain injury.
Our client was successful patent attorney in Northern California. He was standing next to his car on the side of the highway helping his son in the back seat when he was struck by a car going 60 miles per hour driven by a woman who was high on prescription drugs. Our client was taken by helicopter to the trauma center at Stanford where he remained in a coma for 11 days. He eventually woke up but has suffered a substantial traumatic brain injury with petechial bleeding of the frontal lobes noted in CT scans and MRIs. He was the primary breadwinner for his family. After diligent therapy and rehabilitation, our client is back practicing law on a more limited level, although he had to choose a job that was less demanding than his prior job, and thus less high paying. The case settled for a substantial confidential sum with the driver’s insurance and our client’s substantial underinsured motorist insurance carrier.
Our client was riding his bicycle on a roadway when he was hit head-on by a car. The primary impact was to his skull around his eye and unprotected by his bicycle helmet. The client suffered a subdural hematoma in the dura inside the skull and outside the brain, causing compression and hypoxia to critical brain tissue. When he attempted to return to his demanding job, he was unable to work at his prior levels. What had been routine tasks now required significantly more energy. He was exhausted at the end of the day, getting half as much done in twice as much time. Although his compensation was somewhat reduced after his injury, it was difficult to prove a close link between his injury and a significant loss of income. We currently represent a scientist with a PhD. from the University of California, Berkeley who suffered a traumatic brain injury when the car she was riding in was rear-ended at high speed on a freeway offramp. Although she suffered no direct blow the the skull, the force of her brain shaking back and forth inside her skull (referred to as cous-countercoup) when her body lurched backward and then forward when the car was hit was sufficient to cause a traumatic brain injury that has resulted in significant fatigue and migraine headaches that delayed her graduating from her PhD program, and currently impacts her ability to work at her pre-injury level.
