The senior attorney at The Zinn Law Firm, Carter Zinn, is not just a successful attorney – he is a parent as well. Perhaps for this reason, we have a particular passion for representing families where either mother or child has suffered serious, life-altering injuries during pregnancy and childbirth.
The miracle of childbirth is something to behold. The vast majority of the time, babies are born without complication and after a day or two, mother and baby are sent home, healthy and thriving. But some pregnancies and deliveries have a different result. Certain complications of pregnancy can result in injury to mother and/or child during pregnancy or delivery when the treating physician fails to exercise due care. These complications can include:
When factors like these are present, the physicians involved in the delivery of the child must exercise particular care to monitor the condition of the fetus to make sure that the baby is safe and getting sufficient oxygen. The failure to do so can lead to tragic results.
When the facts show that medical professionals do not exercise due care in monitoring the health of the baby during pregnancy or childbirth, tragic consequences can occur, including death of the child, death or serious injury to the mother, or life-long developmental challenges for the child. For example, prenatal (prior to delivery) and perinatal (during or after delivery) hypoxia (lack of sufficient oxygen) can cause permanent brain damage to the child, including cerebral palsy, resulting in life-long developmental disabilities and challenges. Improper delivery technique can result in broken bones, or even spinal cord damage to the baby. Also, if the mother had improperly treated infections during pregnancy, this too can result in serious injury to the baby.
In cases where the baby is injured due to prenatal or perinatal hypoxia, or other causes, you need to hire an attorney who can dig deep into the medical facts to discover if the injury to the child was caused by a failure to exercise due care. If the medical facts support this conclusion, your attorney needs to be prepared to advocate to recover enough money to take care of your brain-injured child’s needs for their entire lives, even after the parents’ passing. These are called “life care plans”, and they can total up to tens of millions of dollars in the most serious injury cases.
The insurance companies that sell professional liability insurance to doctors and hospitals that cause these kind of injuries are very profitable and have significant financial assets at their disposal. For this reason, you can be assured that the physicians and medical professionals whose mistakes injured you or your child during pregnancy or delivery will have experienced, battle-tested attorneys and medical experts on their side. The Zinn Law Firm is very prepared for this. In such cases, you need experienced trial lawyers who have the knowledge, experience, skill, and resources to fight against these forces so that you can obtain the funds you will need to give your injured child as normal a life as possible. We are proud to represent families who face such challenges.
When medical complications arise during pregnancy and birth, the mother can also suffer significant, and in some cases, life-changing injuries to their reproductive organs, uterus, and other significant medical injuries. We have had the privilege of representing several mothers injured during child birth due to medical mistakes.
